WHAT IS THE PROGRAM?
The Gildan "I Support…" Program (simply "Program") asks people in Canada and the United States to visit www.genuinegildan.com and tell Gildan Activewear SRL (simply "Gildan" or "the Sponsor") which registered charity (simply "Charity") they support and how that Charity is having a genuine positive impact on the world.
Based on a mathematic equation including number of supporters, number of "likes" per story and a combined average of the number of times a story has been viewed and the number of times the story has been "liked", a list of 10 Charities will be determined. Each of these 10 Charities will be contacted by the Sponsor to determine their interest in participating in the program.
A panel of qualified judges, as determined and assembled by the Sponsor, will determine one Charity to receive up to $100,000USD based on the quality of their submissions and alignment with Gildan’s Genuine Stewardship core values.
Program participants are nominating Charities to win up to $100,000USD. Gildan will manage the donation directly once the Charity has been determined.
No purchase necessary.
WHAT IS AT STAKE?
For every Ultra Cotton (style 2000) t-shirt purchased from the Gildan Genuine Color Collection, a percentage of proceeds – up to $100,000 – will be donated to charity.
One (1) Donation of up to $100,000 will be awarded by Gildan to the winning Charity as selected by the panel of qualified judges.
The story submissions of all Program participants will appear on www.genuinegildan.com.
Donations are not substitutable or transferable. All taxes and other expenses, if any, are the sole responsibility of the selected Charity. This Program is void where prohibited or otherwise regulated. All federal, state, provincial and local laws apply.
WHO CAN PARTICIPATE?
All legal residents of Canada and the United States are eligible to make a submission. This Program is governed by the laws of Canada and the United States, with Canadian laws taking precedent in the event of any contradiction.
Program participants may focus their story submissions on any registered Canadian or US 501(c)3 charity. Support and story submissions provided for Charities that do not meet these criteria will be disqualified and removed from www.genuinegildan.com.
Certain areas are not eligible for participation including:
- Individual study, research or travel grants
- For-profit ventures
- Religious organizations for religious purposes
- Political campaigns or lobbying
- Endowments, capital campaigns or memorials
Organizations receiving support must provide services to persons regardless of their race, religion, gender or political affiliation.
Individuals who are representing themselves, and/or non-registered charities will not be eligible to receive the donation. Inappropriate stories, charities and/or content will be immediately removed from the site without any confirmation in writing or otherwise.
HOW DO I PARTICIPATE?
Participants may participate in the Program either online or at Gildan’s booth at one of the following tradeshows in 2010:
- Imprint, Toronto, ON
- PPAI, Las Vegas, NV
- ISS, Long Beach, CA
- ISS, Orlando, FL
- ISS, Atlantic City, NJ
1) Online entry. Visit www.genuinegildan.com and submit the name of the Charity you support and tell Gildan how they are making a genuine positive impact on the world. Ensure that all requested information is filled out properly and completely. Submissions must not use profane or otherwise inappropriate language, nor make false claims about the mission, work or reputation of any Charity or the Program Sponsor.
All electronic entries must be received by September 29,, 2010. A valid e-mail address is required to make a submission. A maximum of one submission per e-mail address is permitted.
The Sponsor is not responsible for any changes or effects caused to the entrant's computer system as a result of submitting electronic entries. Only entries submitted via the website electronic form will be accepted. Entries submitted via facsimile or other express delivery services will NOT be accepted. The Sponsor is not responsible for lost, late, misdirected or otherwise undeliverable mail, or entries that cannot be processed due to phone, network, electronic or computer hardware or software failure, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause), failed, incomplete, garbles, jumbled or delayed computer transmissions which may limit one’s ability to participate in the Program, or technical failures of any kind, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Program or downloading any materials in this Program. The Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Program should (in its sole discretion) if a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Program. In such case, Gildan will select the recipient from all eligible entries received prior to and/or after (if appropriate) the action taken by Gildan. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Program or website or violates these Terms & Conditions.
CAUTION: ANY ATTEMPT BY ANY PARTICIPANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE A VIOLATION OF CRIMINAL OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
By submitting your expression of support for any eligible Charity, you accept all Program rules and agree to be bound by the decisions of the judges, which will be final. You also agree that by participating in this Program, Gildan reserves the right to publish your submission online and via print and broadcast media. If your submission leads to the selection of ten finalist Charities, it becomes the sole property of Gildan, which reserves the right to edit, adapt, copyright, publish, transfer and use all or a part of your entry without compensation.
2) Tradeshow participation. Attendees at any of the five above-mentioned trade shows may participate in the Program at the Gildan booth. Depending on the date of the tradeshow, submissions will either be stored securely and transferred to www.genuinegildan.com upon its launch or made directly to www.genuinegildan.com in the same fashion as described in section 1) Online entry.
Gildan will be collecting personal data about participants online, in accordance with its privacy policy. Please review Gildan’s privacy policy at www.genuinegildan.com. By participating in the Program, participants agree to Gildan’s collection and usage of their personal information and acknowledge that they have read and accepted Gildan’s privacy policy.
HOW WILL SUBMISSIONS BE JUDGED?
All submissions must meet the Program requirements. The ten finalist Charities will be chosen based on a cumulative score arrived at by measuring the following criteria (each carrying equal weight to arrive at a list of the ten most successful entries):
- 33% based on the total number of supporters for the specific charity upon which the submission focuses
- 33% based on the total number of "likes" for the specific submission
- 33% based on the combined average of the number of times a submission has been viewed and the number of times the submission has been "liked"
Participants who submit an expression of support are "voting" for the Charity they would like to see receive the donation. Participants may only express their support once and can only do so for one Charity.
Visitors to the site are able to "like" submissions without registering a Charity or providing a submission of their own. Participants who submit a story are also eligible to "like" the submissions of others. There is no limit to the number of "likes" a visitor/participant can make.
A panel of qualified judges with relevant knowledge, as determined and assembled by Gildan, will choose the Charity that will receive up to $100,000USD based on the quality of each Charities stories and their alignment with the core fundamental values of Gildan Genuine Stewardship, through a thorough review of each of the story submissions provided for each of the ten finalist Charities. Gildan will choose the panel of judges and reserves the right to replace any members as necessary or deemed appropriate by Gildan. Gildan employees are permitted to sit on the judging panel.
Judges will choose the Charity that will receive up to $100,000USD based on the subjective perception of its quality, as measured against Gildan’s definition of Genuine Stewardship. At Gildan, Genuine Stewardship is "an underlying principle by which we voluntarily take responsibility for the long term social, environmental and economic sustainability of our activities and leverage our efforts to inform and influence various stakeholders." The decision of the judges is final in all matters relating to this Program.
By participating, all participants warrant and represent that their respective story submissions will not infringe or violate the rights of any third parties, including but not limited to copyrights, trademarks and/or rights of publicity/privacy. If Gildan, in its sole discretion, has reason to believe that any story submission contains any material that may infringe or violate the rights of a third party, Gildan may disqualify such participant and take all other measures Gildan may deem appropriate to protect its interests.
By participating, participants, finalists and the donation recipient agree to release and hold harmless the Sponsor, the Charity that will receive up to $100,000USD, their respective advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in the Program, or possession, acceptance and/or use or misuse of donation or participation in any Program-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. In case of dispute as to the identity of any participant, submission will be declared made by the authorized account holder of the e-mail address submitted at time of submission. "Authorized Account Holder" is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.
WHAT HAPPENS IF THE CHARITY I SUPPORT RECEIVES UP TO $100,000USD?
If your Charity is short listed to the list of 10 finalist Charities, that Charity will be notified September 1 through September 30, 2010 via e-mail and/or phone, as well as through social media updates. Your submission will also be highlighted as part of the list of 10 finalist Charities on www.genuinegildan.com.
The Charity to receive up to $100,000USD, to be announced between January 1st and January 30th, 2011, as determined by the panel of judges, will be notified in the same manner.
Representatives of the 10 finalist Charities will be required to sign an affidavit of eligibility and a liability release/assignment of rights and return it within ten days of receipt of notification. Any Charity who is ranked within the 10 finalists and who does not comply with this requirement or cannot be easily located may forfeit the donation and an alternate recipient may be selected.
The 10 finalist Charities and the Charity who receives up to $100,000USD will be notified once they have been short listed via email and phone. If the selected Charity does not wish to be affiliated with the Program, the qualified panel of judges will select a replacement donation recipient. Gildan reserves the right to dictate the terms in which the Charity who receives up to $100,000USD refers to the Program, the receiving participants or the Charity’s status as receiver of the donation. The responsible use of the donation is the sole responsibility of the receiving Charity. Gildan is not responsible for any costs incurred by the Charity associated with its donation or decisions to promote or otherwise communicate its status as the recipient of the donation. If the donation is accepted, Gildan reserves the right to use the name of the receiving Charity in reference to the Program, its results, impact and intentions.
Gildan reserves the right to cancel this Program at its sole discretion. The donation recipient will be posted at www.genuinegildan.com by February 28th, 2011, following the Program end date and after the donation recipient has been notified.
